By placing an order or using our services, you (“the Customer”) agree to be bound by these Terms and Conditions. We specialize in creating personalised, custom digital birthday video greetings based on user-submitted details, images, and preferences.
2. Ordering & Payment Processing
- Order Submission: Orders are placed directly through our online ordering form. You must ensure all information, names, instructions, and uploaded media are accurate at the time of submission.
- Payment Methods: Payments are processed securely via our payment gateway partner, Stripe.
- Bank Statement Descriptor: Charges on your bank, credit card, or financial statement will appear under the legal name Mikonia Ltd.
- VAT: Mikonia Ltd is currently not registered for VAT; therefore, no VAT is charged on top of the listed order prices.
3. Production Timelines & Delivery Options
We offer two distinct delivery tiers for custom video creation:
- Standard Video Production (5 Working Days): Our standard turnaround time for order processing, video rendering, and quality checks is 5 working days from the date of successful payment and receipt of all required media content. Working days exclude weekends (Saturday and Sunday) and official UK Bank Holidays.
- Express Delivery Option (£20 Extra Fee): Customers requiring faster fulfillment can select our Express Delivery service during checkout for an additional fee of £20. Express orders are prioritized and dispatched within 24 to 48 hours of receipt of all required media.
- Digital Delivery Method: Completed videos are delivered as digital media files via a secure download link sent to the email address provided during checkout. No physical product (such as DVD or USB) is shipped.
4. Cancellation & Refund Policy (Bespoke Digital Content)
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015, special rules apply to bespoke and custom-made digital items:
Bespoke Exemption: Because every video is uniquely customized to your specifications, orders cannot be cancelled or refunded once production has commenced, except in cases of technical defects or failure on our part to follow explicit written instructions.
- Errors Made by Us: If we make a spelling, technical, or production error that contradicts the information provided in your original order form, we will rectify and re-issue the video free of charge or offer a full refund.
- Errors Made by Customer: We are not responsible for typos, incorrect dates, incorrect pronunciation guides, or poor-quality photos supplied by the customer. Any re-editing required due to customer error may be subject to an additional editing fee.
- Express Delivery Fees: If an Express Delivery fee (£20) was paid and we fail to deliver within the expedited timeline due to our delay, the £20 fee will be refunded, and the order will revert to standard production.
5. Customer Responsibilities & Media Copyright
- You confirm that you own or have obtained all necessary permissions/licenses for any images, videos, audio clips, or trademarks provided to us for inclusion in your birthday video.
- You agree not to upload any content that is unlawful, defamatory, offensive, discriminatory, or infringes upon any third party’s intellectual property rights. We reserve the right to decline any order containing unacceptable material.
6. Intellectual Property & Usage License
Mikonia Ltd retains all underlying rights, copyright, and ownership of digital video templates, standard audio tracks, animations, and software project files used to create the final product.
Upon full payment, you are granted a non-exclusive, personal, non-commercial license to stream, share, download, and broadcast the final birthday video for personal and family celebrations.
7. Limitation of Liability
While we make every effort to meet stated production deadlines, Mikonia Ltd shall not be liable for delivery failures or technical outages caused by incorrect customer email addresses, third-party internet service disruptions, or events beyond our reasonable control.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
